1. Who we are

Katu Alfajores is a food business based in Edinburgh, Scotland, selling handmade alfajores for delivery within the United Kingdom. Our business details are at the end of this page.

2. Ordering

An order is an offer to buy. We accept it when we send the order confirmation email, at which point a contract is formed. We may decline an order, for example when a postcode cannot be served, when we have reached our baking capacity for the dispatch day, or when a payment cannot be taken.

All our products are baked to order. The dispatch day shown at checkout and in your confirmation is the day we expect to post your box; it is an estimate, not a guarantee.

3. Prices and payment

Prices are in pounds sterling. We are not VAT registered, so no VAT is charged or shown. Delivery is charged in addition and shown before you confirm. The total you pay is calculated on our server when the order is placed; prices shown earlier in the journey are indicative.

Card payments are processed by Stripe. We never see or store your card details.

4. Delivery

We deliver within the UK by Royal Mail or, where offered, by local delivery or collection in Edinburgh. Delivery estimates are those of the carrier. Risk in the goods passes to you on delivery to the address you gave. Please make sure the address and postcode are correct: we cannot redirect a parcel once posted.

5. Cancellation and the perishable-goods exemption

Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 you normally have 14 days to cancel a distance purchase. That right does not apply to goods liable to deteriorate or expire rapidly. Our alfajores are fresh food with a short shelf life, so once an order has been dispatched it cannot be cancelled or returned for a change of mind.

You may cancel an order free of charge at any time before we start baking it. Email us with your order number; if baking has not begun we will refund you in full.

6. Faulty or damaged goods

Nothing in these terms limits your rights under the Consumer Rights Act 2015. If your order arrives damaged, is not as described or is not of satisfactory quality, please tell us as soon as you can, ideally within three days of delivery and with a photo, because food does not keep. We will replace it or refund it, including the delivery charge. This does not affect your statutory rights.

7. Allergens and food safety

Full allergen information for every flavour is published on this website and on the box label. Our kitchen handles milk, eggs, wheat (gluten), tree nuts, peanuts, soya and sesame. We take care to avoid cross-contamination but cannot guarantee any product is free from them. Please store the product as instructed and consume by the best-before date on the box.

8. Gifts

When you send a box as a gift, you are the customer and the recipient is the person you name. We never include prices in a gift order. Gift messages are included as supplied; we may decline to include offensive content.

9. Our liability

We are responsible for foreseeable loss caused by our breach of these terms or our negligence. We are not responsible for losses that were not foreseeable, for business losses, or for delays caused by events outside our control such as carrier failure or severe weather. Nothing excludes liability for death or personal injury caused by negligence, for fraud, or for anything that cannot lawfully be excluded.

10. Discount codes

Discount codes are subject to the conditions shown when issued, may be withdrawn at any time, cannot be exchanged for cash and apply only to the order on which they are used.

11. Law and disputes

These terms are governed by the law of Scotland and the courts of Scotland have jurisdiction, although if you live elsewhere in the UK you may bring a claim in your local courts. If you have a complaint, please email us first; we aim to resolve every issue directly.
